Terms of Service & Service Agreement

Last Updated: July 13, 2026

Please read these Terms of Service & Service Agreement carefully before using the My Pocket Church website or engaging our services. These terms constitute a legally binding agreement between you and My Pocket Church, governing both your use of this website and the services we provide.

1. Acceptance of Terms & Effective Date

This Service Agreement ("Agreement") is entered into between My Pocket Church ("Provider," "we," or "us") and the client ("Client," "you") identified on this dashboard. By accessing or using the My Pocket Church website (mypocketchurch.com) and by making payment and activating your plan, you acknowledge that you have read, understood, and agreed to be bound by the terms set forth in this Agreement. If you do not agree to these terms, please do not use our website or services. The effective date of this Agreement is the date your initial payment was processed. These terms apply to all visitors, clients, and others who access the website or engage our services.

2. Plan & Pricing

Your subscription plan, monthly rate, one-time setup fee, and monthly change request allowance are displayed in the summary above. The one-time setup fee covers initial website design, development, and onboarding. The monthly fee covers ongoing website management, hosting, security, SEO content, and support services. Monthly fees are billed in advance on the same date each month as your original activation. Setup fees are non-refundable once work has commenced.

3. Website Design & Development

Provider will design and develop a custom church website based on your selected plan tier. The scope of included pages is defined by your plan. Additional pages beyond the plan limit may be purchased as add-ons. The website will be mobile-optimized, ADA-compliant (per plan tier), and built on the Base44 platform. Design & Development Process: To ensure efficiency and deliver the highest value, our process is structured for clarity and precision: (a) Asset & Content Procurement: We initiate your project using branding elements — such as logos, color palettes, and imagery — provided directly by you. To streamline content creation, we curate existing copy and assets from your active social media channels or your current website. (b) Design & Delivery: Our team will design and deliver your project based on these foundational elements. This initial phase focuses on delivering a cohesive, professional result with minimal changes. (c) Post-Delivery Refinement: We understand that project needs can evolve. Any additional adjustments, content updates, or refinements requested after the initial delivery can be managed via the Change Request Form within your account dashboard. Project Iteration & Revisions: To ensure your project meets expectations, our design process includes two comprehensive rounds of revisions per project phase. This allows for structured, consolidated feedback cycles. Requests beyond these two rounds, or requests that fall outside the original project scope (as defined in your project proposal), are handled through the Change Request Form and may be subject to additional fees. We will always provide a quote for approval before commencing any out-of-scope work.

4. Website Management & Change Requests

Your monthly plan includes a set number of website change requests per month, as displayed in your plan summary. A change request is defined as a submission made through the Change Request tab of your account dashboard, and may include up to three individual modifications per submission (e.g., text edits, image swaps, page additions, layout adjustments). Unused change requests do not roll over to subsequent months. Change requests submitted beyond your monthly allowance may be purchased as add-ons. All change requests are processed within the response time defined by your plan tier.

5. SEO Services & Content

Provider will implement advanced local SEO strategies on your website, including keyword optimization, meta tags, structured data, and local search integration. Your plan includes a monthly allocation of SEO blog articles written and published by Provider to improve search engine rankings. Provider retains editorial discretion over blog content topics while ensuring relevance to your ministry. SEO is an ongoing process and results are not guaranteed within any specific timeframe.

6. Hosting, Security & Maintenance

Provider includes managed hosting on the Base44 platform, SSL certificate provisioning, security monitoring, daily backups (per plan tier), and routine software updates as part of your monthly plan. Provider is responsible for maintaining server uptime and applying security patches. Scheduled maintenance may result in brief periods of unavailability, which will be communicated in advance whenever possible.

7. Give Pots (Online Giving)

Provider offers the Give Pot donation widget, allowing you to accept online donations through your own Stripe Connected Account. Setting up a Give Pot requires a valid Stripe account in your organization's name. Provider charges a platform fee on each donation, in addition to Stripe processing fees, as configured in your account settings. Provider is not responsible for funds held by Stripe or for issues arising from your Stripe account configuration. Tax-deductible receipts are the responsibility of the Client organization.

8. Digital Business Cards

Your plan includes digital business cards for all staff members. These cards are created through the Card Builder and can be shared via link, QR code, or embedded on your website. My Pocket Church branding is displayed on cards by default; removal of branding requires purchase of branding credits as an add-on. Provider is not liable for the accuracy of contact information displayed on cards — it is the Client's responsibility to keep card details current.

9. Church Mobile App (Growth Plan & Above)

For Growth plan subscribers and above, Provider will develop a church mobile application for Google Play and iOS App Store. App store deployment requires active developer accounts (Google Play Console and Apple Developer Program) in the Client's name or Provider's name, as mutually agreed. App store review processes are controlled by Google and Apple and may cause delays outside Provider's control. App features include push notifications, sermon audio, event calendars, and giving integration, subject to plan inclusions.

10. AI Chatbot Services

For plans that include AI chatbot services, Provider will configure and train an AI assistant using information provided by the Client about their ministry, beliefs, service times, and frequently asked questions. The AI assistant operates on Provider's platform and its responses are generated by artificial intelligence. Provider does not guarantee the accuracy or theological alignment of all AI-generated responses and recommends periodic review and retraining. The Client is responsible for reviewing and approving training content.

11. Add-Ons & One-Time Services

Additional services beyond your plan inclusions — such as extra web pages, graphical design work, additional change requests, app setup, AI chatbot training, branding credits, and custom development — may be purchased as add-ons through your account dashboard. Add-on purchases are one-time charges unless otherwise stated. All add-on purchases are non-refundable once work has commenced. Custom development projects require a separate quote and statement of work.

12. Client Responsibilities

To enable timely delivery of services, the Client agrees to: (a) provide accurate and timely information, content, and assets requested by Provider; (b) designate a single point of contact for approvals and feedback; (c) respond to Provider requests within a reasonable timeframe; (d) maintain the accuracy of their own account, payment, and contact information; (e) comply with applicable laws and ensure all content provided to Provider does not infringe on third-party rights; and (f) grant Provider access to necessary third-party accounts (Google Search Console, Stripe, app store accounts) as needed for service delivery.

13. Intellectual Property

Upon full payment of all fees, the Client receives ownership of final deliverables (website content, design assets, and digital cards) created specifically for their project. Provider retains ownership of proprietary methodologies, frameworks, templates, and tools developed in the course of providing services. Provider retains the right to display completed client work in its portfolio and marketing materials unless the Client requests otherwise in writing. Third-party software, themes, plugins, and integrations are governed by their respective licenses.

14. Website Content & Third-Party Links

All content on the My Pocket Church website — including text, graphics, logos, images, and software — is the property of My Pocket Church or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or create derivative works from any content on this site without our express written permission. Our website may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

15. Payment Terms

The one-time setup fee is due at checkout before work begins. Monthly subscription fees are billed in advance and are non-refundable. If a payment fails, Provider will notify the Client and attempt to retry the charge. Accounts more than 15 days past due may have services suspended, including website, app, and change request access. The Client is responsible for any fees incurred in collecting overdue payments. Price increases, if any, will be communicated at least 30 days in advance and only apply to future billing cycles.

16. Cancellation & Refunds

The Client may cancel their monthly subscription at any time with 30 days written notice by contacting support through the Help & Support tab. Cancellation takes effect at the end of the current paid billing cycle. Setup fees are non-refundable once website development work has commenced. If Provider fails to deliver agreed-upon services, the Client may be entitled to a partial refund of monthly fees, determined on a case-by-case basis. Upon cancellation, Provider will provide the Client with a reasonable transition period to export their content, after which the website and associated services will be deactivated.

17. Limitation of Liability

Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of its services. Provider's total liability for any claim arising from this Agreement shall not exceed the total amount paid by the Client in the 12 months preceding the claim. Provider is not liable for downtime, data loss, or service interruptions caused by third-party providers (e.g., Stripe, Google, Apple, hosting infrastructure) or by events outside Provider's reasonable control, including acts of God, cyberattacks, or internet outages.

18. Disclaimer of Warranties

All services are provided on an "as is" and "as available" basis. Provider does not warrant that services will be uninterrupted, error-free, or achieve any specific result, including search engine rankings, donation volumes, or app download numbers. Provider makes no representations about the accuracy, completeness, or reliability of any third-party integrations or content.

19. Privacy & Data

Provider handles Client and end-user data in accordance with its Privacy Policy, available at mypocketchurch.com/privacy. The Client is responsible for ensuring their use of Provider's services complies with applicable data protection laws. Provider does not sell Client data. Analytics data collected through Google Analytics or other tools is the property of the Client and is accessible through the Client's own accounts.

20. Third-Party Services

Provider's services may integrate with third-party platforms including but not limited to Google (Analytics, Search Console, Business Profile), Stripe, Apple App Store, and Google Play. The Client is responsible for maintaining active accounts and credentials for these services where applicable. Provider is not responsible for changes to third-party APIs, policies, or pricing that may affect service delivery. Third-party fees (e.g., Stripe processing fees, app store developer fees) are the responsibility of the Client.

21. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall first be addressed through good-faith negotiation. If unresolved, disputes shall be resolved in the courts of Fulton County, Georgia. The prevailing party in any legal proceeding shall be entitled to recover reasonable attorney's fees and costs.

22. Changes to This Agreement

Provider reserves the right to modify this Service Agreement at any time. Changes will be effective immediately upon posting to the account dashboard and website. The Client's continued use of services after any changes constitutes acceptance of the updated terms. Material changes will be communicated via email or account notification at least 30 days in advance.
